Labor Dept. Investigation Results in $35K in Back Wages Paid to Workers

Lee’s Summit, Mo-- The Missouri Labor Department’s Division of Labor Standards (DLS) has required payment of $35,000 in back wages to 16 employees and a $5,000 penalty against general contractor Davlin Services of Kansas City, Inc.  A prevailing wage investigation of a public works project in Lee’s Summit found the contractor had not paid proper wages nor provided required safety training to its employees.

“These construction projects are being built to better our communities and it is vital that those working on the projects are being paid the proper wages and receive the proper safety training,” says Department Director Larry Rebman.  “It is concerning to see a disregard for the law; we will continue to hold accountable those who violate it. “

A state law that went into effect last year requires contractors to provide a 10-hour safety training course to all their employees within 60 days of working on a public works project. The DLS investigation found six Davlin Services employees worked on the site without the required safety training over the course of 26 days during the construction. The penalty is $2,500 plus an additional $100 for each worker employed by the contractor for each calendar day, or portion of a day, that the employee worked on-site before completing the required training. Penalties were assessed against Davlin Services in the total amount of $5,100 for failure to provide six workers the 10-hour construction safety training.

In addition, all 16 employees of Davlin Services were not paid the appropriate prevailing wage rate for the type of work performed. This resulted in back wages being provided to these workers in the amount of $35,105. As a result of the investigation conducted by the DLS, the contractor paid in full the restitution owed to the 16 workers.

So far in 2010, the DLS has received 285 prevailing wage complaints and 462 minimum wage complaints and a total of $423,413 in restitution has been paid to workers owed wages. To file a wage complaint, visit http://www.labor.mo.gov/DLS/General/complaints.asp.
