Western Missouri Public Employees, Local 1812 and Missouri State Council 72, American Federation of State, County, and Municipal Employees v.
Jackson County Department of Corrections, Kansas City, Missouri

AFSCME filed a petition for all non-supervisory employees of the Department of Corrections. Jackson County contended that the employees sought were police, and therefore beyond the jurisdiction of the Board. They also argued that the unit sought was not appropriate and that it would lead to the over fragmentation of bargaining units. Finally, the county argued that Sergeants should be excluded from any unit as supervisors.

The Board found the proposed unit appropriate based on the distinct nature of the Guards’ functions, their separate supervision, and the lack of interchange with other county employees.

The Board found that Sergeants were Lead Workers and not supervisors.

The Board found that Correction Officers were not police. They are not responsible for maintaining order, preventing and detecting crime, or enforcing laws.
