IBEW filed a petition to determine the appropriate unit within the Sanitation Department of the City of Kirkwood. The only question to be determined was whether an individual who serves in a dual capacity, that of a supervisor and that of a regular worker, should they be a part of a bargaining unit. The individual in question performed supervisory duties one day per week and served as a working crew leader five days a week. The Board said that in cases such as this, they must determine where the individual’s community of interest rests. In the present case, the Board found that the individual’s interest lies with his fellow non-supervisors since he spent most of his time in that position.
