County Court of Lincoln County, Troy, Missouri
AFSCME filed a petition for all regular and part-time employees of the Lincoln County Highway Department, excluding Office Clerical and Supervisory Personnel. The Board concluded that Foremen should be excluded from the bargaining unit. The Board found that Assistant Foremen were not true supervisors and should be included. They noted that Assistant Foremen directed only a small work force, and worked alongside the crew they directed. Finally, the Board concluded that Mechanics shared a clear and identifiable community of interest with the other employees, so as to justify their inclusion in the bargaining unit.
