The union filed a petition for certification as public employees representative of all Public Safety Officers employed by the Public Safety Commission of the City of Des Peres. The respondent argued that the Board lacked jurisdiction to hear the case since the Public Safety Officers were police officers as well. The Board agreed with the respondent, and dismissed the petition.
