City of Cabool, Missouri
IBEW filed a petition for all employees of the City of Cabool. The sole issue was the appropriateness of the unit. The Board found that the City Administrator and superintendent were supervisors and should be excluded. The Board found that the department heads were not supervisors since they spent most of their workweek performing the same duties as other employees within their department. Finally, the Board concluded that the Clerical Department Workers did share a sufficient community of interest with the other employees so as to justify their inclusion in the bargaining unit. The City Clerk, however, was excluded as a confidential employee.
The Board approved the bargaining unit, as modified above, and issued an order directing an election.
