The union filed a petition for certain employees of the City of Independence. The City argued that the positions of Tree Trimmer Crew Leader Working, Crew Leader Working, Substation Foremen Working, and Meter Foremen Working should be excluded as supervisors. The Board looked at the supervisory guidelines and concluded that these positions were not supervisory. They noted the lack of authority to effectively recommend the hiring, promotion, transfer, discipline, or discharge of other employees. The working supervisors here primarily supervised activities rather than employees. These working supervisors spend practically all their time working alongside those they oversee.
