International Brotherhood of Electrical Workers, Local 753 v.
City Utilities of the City of Springfield, Missouri

IBEW filed a petition for employees of the City Utilities of Springfield. Prior to the hearing, the parties reached an agreement that three (3) separate bargaining units would more appropriate to represent the employees. The only question before the Board, therefore, was the inclusion of 17 workers. The City contended that two (2) were supervisors and 15 were confidential employees.

The Board applied its supervisory guidelines and concluded that the two employees objected to as supervisors should be excluded from the bargaining unit. The Board concluded that only two (2) of the 15 employees objected to as confidential employees should be excluded. They noted that an employee’s mere accessibility to confidential information does not automatically exclude them. Employees are excluded only if the position requires access to confidential matters as part of their ordinary employment responsibilities.
