IBEW filed a petition challenging the eligibility of two City of Piedmont employees who voted in a certification election held on November 20, 1979. IBEW contended that the employees were supervisors and therefore must be excluded from the bargaining unit. The Board concluded that employee Stevenson was a supervisor. They noted he had the ability to effectively recommend hiring and firing actions. He also directs and assigns the work force and spends much of his time supervising employees, not working along side them. The Board, therefore, concluded that employee Stevenson was ineligible to vote and ordered his ballot destroyed. The Board was not convinced that employee Brinkly was a supervisor. Since the vote, not including Brinkly, was three (3) for the union and one (1) against, the Board certified the election results.
