City of St. Louis, Street Division, St. Louis, Missouri

Local 675 filed a petition for certification as public employee representative of all non-management, non-supervisory, and non-clerical employees of the City of St. Louis Refuse Division. The Miscellaneous Drivers & Helpers Union, Local 610 filed a petition to intervene as public employee representative of a bargaining unit comprised of the Refuse Division employees and other employees of the City of St. Louis Street Division. The City objected only to the certification of a bargaining unit that would include employees from both the Street and Refuse Divisions. The issue before the Board was whether employees from both Divisions constitute separate appropriate bargaining units.

The Board looked at a number of factors and concluded that employees of the Refuse Division do not share a community of interest with the Street Division employees. They noted the lack of personal contact between the employees, the different work sites, different hours, and different supervision.

The Board, therefore, concluded that two (2) separate units were appropriate, and issued an order directing an election.
