AFT filed a petition for all Office Clerical employees in class code 00xx employed by the St. Louis Board of Education. The employer first argued that the petition was barred by an agreement between the employer and the Association of Education Secretaries, the intervenor. The Board concluded that there was no contract bar here because of the limited scope of the agreement. If an agreement is to serve as a contract bar, the terms and conditions of employment governed by the agreement must be substantial.

The employer also contended that Local 420’s petition should be dismissed because the union would be representing both Non-Teachers and Teachers. The Board rejected this argument, and distinguished this case from R 79-020 involving the same parties. Case R 79-020 only established that Teachers and Non-Teachers cannot be represented in the same bargaining unit. The Board also rejected the respondent’s claim that the Secretary unit would be dominated by the Teacher members of the union. The Board noted that only Secretaries would vote on issues concerning them, and they would be in a separate bargaining unit.
