The union filed a petition for all custodians. The School District asserted that those employees designated as Head Custodians and Assistant Head Custodian were supervisory employees. The Board concluded that the Head and Assistant Head Custodians were not true supervisors. They do not act directly or indirectly in the interest of the employer in relation to other employees. They play no significant role in the hiring, promotion, transfer, discipline, or discharge of other employees. They have little authority to direct and assign the work force. Furthermore, they are paid only slightly more than the other custodians. Finally, they spend substantially all their time performing routine custodial duties.
The Board included the Head and Assistant Head Custodians in the unit.
