Independent School Employees, Local 60, Incumbent and Parkway School District, Chesterfield, Missouri
Teamsters filed a petition for all Maintenance and Grounds Departments personnel employed by the Parkway School District. Independent School Employee Union, Local 60 had previously been certified as the public employee representative. Local 60 argued that a verbal agreement between Local 60 and the School District made Local 610’s petition untimely. Since the agreement was merely verbal, the Board concluded that the Contract Bar did not apply.
Secondly, Local 60 argued that Local 610’s petition was incorrect in form. Since Local 60 had already been certified, the petition should have been for decertification. The Board agreed that this was technically correct, but decided not to dismiss since the requirements for decertification and certification were nearly identical. Instead, the Board choose to consider this petition as though it were for decertification.
