Miscellaneous Drivers, Helpers, and Public Employees, Union, Local 610 Affiliated with International Brotherhood of Teamsters, Chauffeurs, Warehousemen & Helpers of America, Intervenor and 21st Judicial Circuit, St. Louis, Missouri
The Union filed a petition for certain personnel employed by the State of Missouri, working in the 21st Judicial Circuit. Teamsters, Local 610, filed a petition as an intervenor. No one appeared on behalf of the petitioner. The intervenor sought a bargaining unit consisting of all the Clerks I-V in the 21st Judicial Circuit.
The first question was who the employer was. Local 610 contended that the 21st Judicial Circuit itself must be considered the employer. The Board concluded that the Supreme Court was the ultimate employer of all the Clerks in the state.
The second issue was whether the Clerks in the 21st Judicial Circuit could make up an appropriate bargaining unit. The Board concluded that the appropriate unit consisted of all Clerks statewide. They relied on the similarity in work done, as well as pay, benefits, and other conditions of employment. They also pointed out the danger of the proliferation of different bargaining units.
Since neither the petitioner nor the intervenor had made the necessary showing of interest this statewide unit, the Board granted an additional 60 days to secure the necessary showing.
