SEIU filed a petition for all full-time and regular part-time employees, excluding supervisors, employed by the St. Louis Public Library System. The respondent argued that those employees classified as Utilities and Maintenance Mechanics I, Building Maintenance Carpenters, and Building Maintenance Mechanics I should be excluded because they do no share a community of interest with the other employees sought. The Board reviewed many factors and concluded that these positions did share a community of interest with the other employees. They noted that there was similarity in pay and supervision. The Board also noted their policy of preventing over fragmentation of bargaining units.
The respondent also argued that employees designated Second-In- Charge were supervisors and should be excluded. The Board concluded Second-In-Charge personnel were true supervisors. They noted that they spent much of their time exercising independent judgment.
