MNEA filed a petition for certain employees of the Belton School District. The issue before the Board was the inclusion of the Clerical Secretaries assigned to the Principals, Assistant Principals, and the Central Administrative office. The School District contended that they were confidential employees. The Board rejected the labor-nexus test adopted by the NLRB because they considered it unworkable. Instead they stated that an employee is confidential, if there exists a confidential relationship between the employee and managerial or supervisory employees. Applying this broader test, the Belton test, the Board concluded that the Secretaries were confidential and should be excluded.
