AFSCME filed to represent employees of the City of Jefferson. In dispute were four (4) classifications: Maintenance Supervisor, Dispatcher, Administrative Secretary, and Fire Training Officer. The City maintained that the Maintenance Supervisor and Dispatcher were supervisors and should be excluded. The Board concluded that neither were truly supervisory. The Board relied on the lack of hiring, firing, and promotion input from these positions. They also noted that the Maintenance Supervisor worked alongside the employees he allegedly supervised.
The Board did find that the Administrative Secretary should be excluded from the bargaining unit as a confidential employee. Finally, the Board excluded the Training Officer because he was involved in the management decisions and helped to formulate, determine, and effectuate the policies of the employer.
