AFSCME filed a petition to represent certain employees of the Water Division of the Department of Public Utilities of the City of St. Louis. The International Union of Operating Engineers, Local 2, intervened to argue that some of the job classifications sought by the petitioner were traditionally represented by trade unions and should be excluded from the bargaining unit. St. Louis Municipal Employee Union, Local 675, also intervened, asking only that the Board find a sufficient showing of interest so as to allow them to appear on the ballot.

The Board ruled that the contract bar rule precluded Local 410 from representing the positions of Waste Treatment Operator and Mechanical Maintenance Operator. The Board ruled that the contract bar did not preclude Local 410 from seeking to represent the general employees sought, since the contract, by its terms, did not clearly encompass these employees.

The Board also found that Local 675 had made a sufficient showing of interest to be on the ballot.
