The union filed a petition to represent certain employees of the Public Works Department of the City of Sikeston. The only issue before the Board was whether four (4) employees classified as Working Crew Leaders should be excluded as supervisors. The Board concluded that the Working Crew Leaders assigned to the Street Division were not true supervisors. The Board noted that these leaders worked alongside the other workers and only supervised activities, rather than employees. The Board also concluded that the Working Crew Leader assigned to the Parks Division was not a supervisor, despite the fact that he substitutes as the Public Works Superintendent for five weeks a year. The Board found such temporary status as supervisor insufficient to justify exclusion from the bargaining unit.
The Board issued a decision that the Crew Leaders were not supervisors.
