SEIU filed to represent Cooks at the Meramec Valley R-3 School District. The District contended that eight (8) Cooks, classified as Head Cooks, should be excluded from the unit as supervisors. The Board concluded that the Head Cooks were true supervisors and must be excluded. The Board ruled this way despite the fact that the regular Cook to Head Cook ratio was only 2 to 1, and the fact that Head Cooks performed many of the same duties as regular Cooks. The Board found that the amount of independent discretion given the Head Cook without any direct supervision justified their status as supervisors. They also noted that Head Cooks had significant input in hiring decisions and were paid more than regular Cooks. The Board issued a decision excluding Head Cooks.
