IBEW filed a petition for all full-time and part-time Transmission and Distribution employees in the Electrical Department of the City of Higginsville. The City contended that the Electric Distribution Foreman should be excluded as a supervisor. The Board concluded that the Foreman was a Lead Worker and not a true supervisor. The Board noted that he spent most of his time doing the same type of work performed by the line employees. The Board found that any oversight function was incidental to his supervising of the line of work activity. The Board did, however, find that the Electric Supervisor was a supervisor, and since the person who was the Electric Distribution Foremen was also acting temporary Electric Supervisor, he should be excluded if he is still acting in that capacity at the time of the election.
