The union filed a petition for a bargaining unit composed of all full-time Mechanics and part-time Bus Drivers in the Hillsboro R-III School District. The parties stipulated that this was an appropriate unit. The only issue was whether HESA is a proper petitioner and whether HESA is a labor organization. Since Missouri law does not define labor organization, the Board looked to the NLRB definition, 29 U.S.C. §152(5). Accordingly, it is a labor organization if employees participate in the organization and the organization exists for the purpose of dealing with grievances, labor disputes, wages, rates or pay, hours of employment, or conditions of employment. The Board concluded that HESA was a labor organization under this definition. In addition the Board concluded that HESA’s plans to affiliate with MNEA and NEA, did not raise a legal barrier to its representation of Non-Teachers here.
