SEIU filed a petition for all Service, Maintenance, and Technical employees of Monroe Manor Nursing Home. The sole dispute was whether Charge Nurses should be excluded from the unit as supervisors. The Board found that the Charge Nurses were in fact supervisors. The Board noted that Charge Nurses directed other employees on a day-to-day basis, approved overtime, and assigned involuntary overtime. Furthermore, they are often the highest ranking personnel on duty, and may discipline other employees and suspend employees for the remainder of a shift. Finally, the Charge Nurses evaluate other employees, and this evaluation is tied directly to the employees wage. The Board, therefore, excluded Charge Nurses from the bargaining unit and issued an order directing an election.
