Teamsters, Local 245 filed a petition for certification as public employee representative for certain employees of the Lawrence County Nursing Home District. The sole dispute was whether LPN’s and Graduate Practical Nurses, referred to collectively as Charge Nurses, should be excluded from the bargaining unit as supervisor. The Board applied the supervisory criteria and determined that the Charge Nurses were not true supervisors. The Board noted that the Charge Nurses do not hire, fire, promote, or transfer employees, and have only a limited role in disciplining and evaluating employees. While the Charge Nurses do direct the CNA’s and LMT’s under them, their role is more as a Lead Worker than a supervisor. They supervise activities rather than employees. The Board distinguished the result where with the Monroe Manor Case No. R 1991-016.
