The issue in this case was the composition of the bargaining unit. Specifically, whether the Code Enforcement Officers comprised an appropriate unit. The City objected to the proposed unit as an inappropriate attempt by SEIU to carve out four (4) positions from an appropriate unit of twenty-one (21) Community Service employees. The Board applied its usual test and determined that the proposed unit was inappropriate.
