Service Employees International Union, Local 96, AFL-CIO v.
City of Raytown, Missouri

The Board’s decision excluded the clerical employees of the City of Raytown because they do not share a community of interest with the Service and Maintenance employees.

Seasonal employees of the Department of Parks & Recreation were excluded because they lacked a community of interest with other employees of the city. Also excluded were Maintenance I, II, and III of the Parks Department because of the dissimilarity in supervision and personnel policy, and the lack of significant contact and interchange between these and other employees of Public Works.

In the Public Works Department, the foremen were determined to be more of a Lead Man than a supervisor and were included in the unit. Regularly scheduled part-time employees were included because the Board found that they did share a community of interest with the full-time employees.

The Board also found that the City Hall Custodian should be included in the bargaining unit because they are supervised by the Administrative Assistant of Public Works. Other city employees (Bailiff, Records & Detention Clerk, Communication Technician, School Crossing Guard, General Health Officer, Engineering Aide, and Building Inspector) did not have a community of interest with the Service and Maintenance employees and were excluded from the unit.
