MNEA filed a unit clarification petition to determine the supervisory status of six (6) high school Head Custodians employed by the District. The Board concluded that the Head Custodians were not true supervisors. They have no role in the hiring, promotion, discipline, or discharge of other employees. The Board said that the mere direction of other employees when little, if any, independent judgment, or discretion is exercised, does not constitute true supervisory authority. The Head Custodians were found to supervise activities, rather than employees. Finally, a substantial majority of the Head Custodians’ time was spent performing duties similar to those of the other Custodians. The Board issued a UC which included the Head Custodians.
