The District filed a petition for clarification of an existing bargaining unit. In its petition the District sought to exclude from the bargaining unit the Food Service Financial Analyst and the Staging/Move Coordinator as supervisors. The District also sought to exclude from the bargaining unit the Food Service Financial Analyst, the Network Manager, the Accounting/Payroll Technician, the Coordinator of the Community Use Facilities, the Payroll Analyst II, and the Payroll Analyst I as confidential employees. The Union conceded the need for clarification of the bargaining unit, but objected to the exclusion of the said job classifications from the bargaining unit.
As for the Food Service Financial Analyst and the Staging/Move Coordinator job classifications, the Board applied the traditional supervisory factors and found that the two (2) job classifications were not supervisors.
As for the Food Service Financial Analyst, the Network Manager, the Accounting/Payroll Technician, the Coordinator of Community Use Facilities, the Payroll Analyst II, and the Payroll Analyst I, the Board applied the labor/nexus test and found that the six (6) job classifications were not confidential employees.
Therefore, the Food Service Financial Analyst, the Staging/Move Coordinator, the Network Manager, the Accounting/Payroll Technician, the Coordinator of Community Use Facilities, the Payroll Analyst II, and the Payroll Analyst I remained in the bargaining unit.
